How to Take the IRS to Tax Court

Act fast when you disagree with a decision the IRS has made about your tax liabilities. If you have received a Notice of Deficiency, Notice of Determination, or Notice of Certification from the IRS, you have ninety days from the date of the notice to petition the US Tax Court with a contest and your reasons for disagreement.

There is a filing fee you will have to pay, unless you file an application to proceed without it.

Preparations

The IRS has sixty days to file a response to your claim. If the court decides to proceed, both parties will engage in pretrial discovery and other trial preparations, including gathering evidence.

The IRS assesses additional taxes when it reviews a tax return and determines a taxpayer or business has not sufficiently calculated its liability. These additional taxes can include interest on overdue taxes and penalties, which can quickly add up. Depending on the issue, a tax assessment can add thousands or even hundreds of thousands of dollars to your tax bill.

Even if a taxpayer or business hasn’t filed a return, the IRS can calculate an assessment based on W-2s, 1099s, payroll tax filings, and other information submitted to the agency. If you have not filed, the IRS cannot account for deductions, credits, or other adjustments. As a result, tax assessments for non-filers often lead to a higher assessment than the actual tax due.

The US Tax Court is a special federal court that exclusively deals with tax issues. Judges rule based on their own tax expertise and the arguments made by the respondent (the IRS) and the petitioner (you). Individual states have their own tax courts as well. The Georgia Tax Tribunal is a state court that hears cases involving taxpayers and businesses with the Georgia Department of Revenue (DOR). It handles disputes that cannot be resolved with the DOR, including appeals involving Georgia income tax, sales and use tax, withholding taxes, and certain other taxes.
